1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 15/2016 registered at P.S. G.R.P. Raipur, Distt. Raipur (C.G) for the offence punishable under Section 20 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

2. As per the prosecution case, on 04.02.2016 the police had a tip-off that the applicant was carrying contraband Ganja and on such information, when a raid was conducted, 13 Kgs., of Ganja was recovered from the applicant.

3. Learned counsel for the applicant would submit that the applicant has been falsely implicated and in fact no seizure was made in person from the applicant. It is also submitted that the charge sheet has been filed and the applicant is in jail since 04.02.2016, therefore, he may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail.

5. Perused the case diary and documents. It appears that from

the possession of the applicant 13 Kgs., of Ganja was recovered. Considering the alleged recovery and quantity of Ganja, I am not inclined to allow this bail application. Accordingly, it is rejected.
