The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.14/2016 registered in Police Station G.R.P. Raipur District Raipur (CG) for offence punishable under section 20 of Narcotic Drugs & Psychotropic Substances Act. 2.

As per the prosecution case, on an information received on 4/02/2016 that the applicant is in possession of the cannabis, on raid being conducted at railway platform from the possession of the applicant 10 kg of cannabis were recovered.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, no seizure was made in person from the appliant and it was from the open place, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Considering the facts and circumstances of the case, nature of recovery and the fact that IO who is important witness of seizure is still remains to be examined and also considering the quantity of cannabis

seized, this court is not inclined to release the applicant on bail. 6.
