1. The challenge in the present Writ Petition is to the impugned order Annexure P/1 dated 22.08.2019 whereby the services of the petitioner has been transferred from Jashpur to Balrampur.

2. Contention of the petitioner is that for the last 22 years, the petitioner is posted at Jashpur and now the petitioner has again been sent to another scheduled area, whereas under the scheduled area policy of the State Government the petitioner is entitled to be posted in a non scheduled area. Counsel for the petitioner submits that petitioner has already made a representation to the State

Government for considering the case of the petitioner of being transferred to any non scheduled area in the State.

3. Given the aforesaid circumstances of the case, let petitioner make a representation to respondent No.1 within a period of 10 days and on receipt of the representation, the respondent No.1 in turn shall consider the case of the petitioner for being transferred to a non scheduled area anywhere in the State within a period of 45 days.

4. Till the representation of the petitioner is decided, the effect and operation of the impugned order shall remain stayed so far as petitioner is concerned.

5. With the aforesaid observations, the writ petition stands disposed of.
