Hon'ble Shri Justice P. Sam Koshy Order On Board 10.12.2021

1. The present writ petition seems to have been filed seeking for a relief for an appropriate direction for the Competent Authority to pass an appropriate order on the application that the petitioner has preferred under the provision of Chhattisgarh Lok Sewa Guarntee Adhiniyam 2011.

2. It goes without saying that when an application has been moved in accordance with a particular Act, the Competent Authority empowered has to take a decision strictly in accordance with the procedure prescribed under the said Act at the earliest.

3. Given the fact that the application in the instant case seems to have been filed only on 12/13.10.2021 and in less than two months time, the present petition has been filed, the present writ petition at this juncture stands disposed of expecting from the concerned authorities under the aforementioned Act of 2011 to take an appropriate decision at the earliest.

4. It is made clear that this Court has not expressed any opinion so far as merit of the case is concerned. The authorities are at liberty to take a decision strictly on its own merits in accordance with law.
