1. Heard.

2. This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.52/2012 registered at Police Station Charama, District Kanker, for the offence punishable under Sections 420, 409, 406 & 477A of IPC.

3. It is argued by learned counsel for the applicant that in the earlier bail rejection order, liberty was reserved in

favour of the applicant to move again if the trial does not demonstrate substantial progress. He would further argue that the evidence of the prosecution has not yet begun, therefore, the applicant, who is in jail since 29.02.2016 is entitled to be released on bail.

4. Having considered the length of pre-trial detention of the applicant and for the fact that the offence is triable by the Judicial Magistrate First Cass and the recording of evidence may take some more time, the application for grant of bail is allowed.

6. The applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court/remand Court. He is directed to appear before the said Court on each and every date given by the said Court.
