1. The present contempt petition has been filed alleging the noncompliance of the order dated 15.04.2019 passed by this Court in WPS No. 2859 of 2019.

2. This Court had directed the respondents to settle the issue of unpaid salary of the petitioner in terms of an order earlier passed by the Additional Secretary in the Department.

3. The respondents today entering appearance have relied upon a document dated 13.11.2019 stating that the unpaid salary is in respect of a period when the petitioner was allegedly on unauthorized absence.

It is the further contention of the petitioner that for the said period of unauthorized absence a departmental inquiry has already been contemplated and it is in the process of being finalized and therefore the payment of unpaid salary for the said period cannot be or could not be finalized.

4. Given the said submission by the counsel for respondents, this Court is of the opinion that a satisfactory explanation has been provided by the respondents for non-compliance of the order.

5. Be that as it may, reserving the right of petitioner to avail appropriate remedies available to him and to approach the Court against the enquiry so initiated or any other action of which the petitioner is aggrieved, this contempt petition at this juncture stands disposed of.
