Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 12/12/2017

1. The applicants have preferred these applications for grant of

bail as they are arrested in connection with Crime No.91/2017 registered at Police Station Birra, District Janjgir Champa for offence punishable under Sections 379 and 411/34 of the IPC.

2. Applicant Sanju Giri committed theft of motorcycle and sold it to other applicant Dharam Giri.

3. As against Sanju Giri, learned State Counsel would point out 4 previous offences of similar nature. There being no previous antecedents of applicant Dharam Giri and in the present offence, he appears to be recipient of the stolen property but was not alleged to be involved in committing theft, this Court is inclined to release the applicant Dharam Giri on bail.

4. Accordingly, the application {MCRC No.6514/2017} is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs. 25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.

5. The application {MCRC No.7215/2017} preferred by applicant Sanju Giri is rejected with liberty to revive after 4 months. Sd/- Judge (Prashant Kumar Mishra) Barve
