1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 189 of 2013 registered at Police Station Jhagrakhand, Distt. Koriya (C.G) for the offences punishable under Sections 394, 397, 450 of IPC and section 25/27 of the Arms Act.

2. As per the prosecution case, on 12.10.2013 the applicant and others entered into the house of complainant Sheela Tiwari and committed decoity and looted the ornaments and cash. Subsequently the applicant was arrested and he was identified by the complainant.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated, the FIR was made against unknown person, no further investigation is necessary and the applicant is in jail since 16.02.2014, therefore, he may be

enlarged on bail.

4. Per contra, learned State Counsel opposes the bail application and submits that the applicant has past antecedents and as many as 25 cases stand registered against him.

5. Perused the case diary and the documents as also the Test Identification Parade. It appears that the applicant appears to have been identified.

6. Considering the past antecedents of the applicant and the back ground of the case, I am not inclined to release him on bail. Accordingly, this bail application is rejected. Sd/- GOUTAM BHADURI JUDGE R a o
