The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.226/2016 registered in Police Station Chakradhar Nagar, District Raigarh (C.G.) for offence punishable under sections 467, 468, 471 & 201 of IPC.

As per the prosecution case, the applicant who was working as data entry operator at Janpad Panchayat, Raigarh forged signature of CEO and transferred the benefit twice to the beneficiaries whereyby loss of Rs.9,90,000/- was caused.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, no evidence is on record to show that the said alleged forged signature was made by the applicant and all the cheques had gone to the beneficiaries account and the applicant was not beneficiary and after one year the incident has been reported, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail and would submit that Shri Ashish Shukla, G.A. is in hold of the matter, he is

not available.

Perused the case diary and the documents. Charge sheet in this case has been filed. Perusal of the documents also shows that different documents have also been seized and all the evidence appears to be documentary in nature. Taking into fact that charge sheet has been filed and the applicant is in jail since 24/07/2017, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
