Learned counsel for the applicant submits that the other co-accused has been acquitted by the Sessions Court, therefore, the counsel seeks permission of this Court to withdraw the instant bail application filed under Section 438 of Cr.P.C. with liberty to the applicant to surrender himself and apply for regular bail before the concerned trial Court and on the same day that may be adjudicated. 2.

Accordingly, the anticipatory bail application is dismissed as withdrawn with the aforesaid liberty.

However, the applicant, if so advised, may surrender and apply for regular bail before the concerned trial Court and if such application is filed, the concerned trial Court shall consider and decide the same on merits as early as possible preferably on the same day.
