The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.34/2016 registered in Police Station New Rajendra Nagar, Raipur (C.G.) for offence punishable under sections 420, 34 of IPC.

As per the prosecution case, the present applicant being one of the director of R.K. Jain & Construction through his power of attorney Ashish Kumar Jain sold the house bearing No.72 admeasuring 1892 sq.ft. to the complainant on 6/08/2011 and subsequently the same house was sold to Fatkanbai on 30/09/2011.

Learned counsel for the applicant submits that charge sheet in this case has been filed, one of the co-accused Ashish Kumar Jain has been enlarged on bail on 20/07/2016 vide M.Cr.C. No.3870 of 2016. He submits that no further investigation would be necessary, therefore the applicant may be released on bail.

Learned State counsel do not dispute the fact that similarly placed co-accused Ashish Kumar Jain has been enlarged on bail on 20/07/2016

vide M.Cr.C. No.3870 of 2016.

Considering the fact that charge sheet has been filed, similarly placed co-accused Ashish Kumar Jain has been enlarged on bail on 20/07/2016 vide M.Cr.C. No.3870 of 2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
