Hon'ble Shri Justice P. Sam Koshy Order on Board 30/07/2021
1. The present contempt petition has been filed alleging noncompliance of the order passed by this Court in WP(S) No. 4613 of 2011 decided on 31.07.2018. For noncompliance, this Court had earlier issued the notices to the respondents.
2. Today, when the matter is taken up for hearing, counsel for the petitioner submits that the order passed by this Court in WP(S) No. 4613 of 2011 was subjected to challenge in WA N0. 810 of 2018, the Division Bench of this Court vide its Judgment dated 24.10.2019, have affirmed the order of the single Bench but have modified only
-2so far as the consequential relief that the petitioner would be entitled for in as much as the back wages has been reduced by 50 %.
3. It is the further contention of the respondents that the order of the Division Bench has subsequently been put to test before the Supreme Court vide the Special Leave to Appeal No. 4774 of 2020 and the Supreme Court is seized of the matter and have directed the petitioner therein to produce the records of Age Determination Committee (In short "ADC").
4. Given the fact that the matter has been seized by the Supreme Court in the aforesaid Special Leave to appeal No. 4774 of 2020, the present contempt petition at this juncture stands disposed of with liberty to present petitioner to revive the contempt petition in case if need so arises after the outcome of the Special leave to appeal pending before the Supreme Court or rejection of the interim application whichever is earlier.
5. The contempt petition accordingly stands disposed of. Sd/- (P. Sam Koshy) Judge J-
