At the outset, counsel for the petitioner makes an oral request for making necessary correction in the serial number of the respondents which has been wrongly got typed.

Let necessary correction in this regard be made by the petitioner during the course of the day itself.

With the consent of the parties, heard the matter finally at admission stage. 4.

After arguing for some time, counsel for the petitioner restricts his claim to the extent that the respondents be directed to immediately release the subsistence allowance which the petitioner was getting from time to time on his suspension i.e. on 7.11.2014 and which has been discontinued from July, 2017 onwards.

Contention of the counsel for the petitioner is that the petitioner is still in suspension and that no final order on the departmental enquiry has been passed by the authorities concerned and therefore there is no reason why the petitioner should be denied the subsistence allowance.

Given the aforesaid facts as have been narrated by the petitioner, the present writ petition is disposed of with a direction to respondents no. 3 & 4 to take immediate steps ensuring the release of subsistence allowance to the

petitioner which has not been released to him and which according to him is due from July, 2017 onwards.

Let an order be passed in this regard within a period of 60 days from the date of receipt of copy of this order.
