1. The challenge in the present writ petition is to the order of transfer dated 23.08.2019 Annexure P-4 whereby the services of the petitioner have been transferred from Sub Health Centre, Birkoni, District

Mahasamund to Sub Health Centre, Ajgarkhar, District Mahasamund.

2. The ground of challenge of the petitioner is the health condition of her husband who pursuant to an accidental injury has suffered locomotor disability to the tune of more than 45% as is evident from Annexure P6, the disability certificate issued by the Govt. of India. According to the petitioner, by virtue of the said disability, her husband who is also a government employee has become totally dependent upon the petitioner for his routine work and therefore, at this juncture, transferring the petitioner would cause great inconvenience and difficulties in the family of the petitioner particularly that of the husband of the petitioner who is a person of disability.

3. Given the aforesaid facts, let the petitioner make a detailed representation in this regard to the respondents within a period of 10 days from the date of receipt of certified copy of this order and the respondents in turn shall consider the representation of the petitioner sympathetically within a further period of 45 days from the date of receipt of the representation.

4. Till the representation of the petitioner is decided, the effect and operation of the impugned order so far as the petitioner is concerned shall remain stayed.

5. With the aforesaid observation, the writ petition stands disposed of. Sd/- P. Sam Koshy Judge Khatai
