The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.261/2016 registered in Police Station Mungeli, Distt. Mungeli for offence punishable under section 409 of Indian Penal Code.

As per the prosecution case, the applicant who was Manager of Paddy Procurement Centre, Pandrabhattha in between the period 1/12/2015 to 31/01/2016 procured 42917.02 quintals of paddy, however subsequently when inspection was made, it was found that 623.82 quintal of paddy was in shortage, it has caused loss of Rs.8,87,479/- to the government ex-chequer. Thereby, offence has been committed. 3.
Learned counsel for the applicant submits that the applicant was served with the notice for which reply was filed wherein it was revealed that some of the paddy was in shortage and total entry was made by the computer operator and as such virtually no loss has been caused, charge sheet has been filed, no further investigation would be necessary and the applicant is in jail since 6/09/2016, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Considering the facts and circumstances of the case, nature of evidence appears to be documentary in nature, charge sheet has been filed and the applicant is in jail since 6/09/2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
