The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.105/2016 registered in Police Station Ranitarai Dist. Durg (CG) for offence punishable under section 306 of Indian Penal Code.

As per the prosecution case, one Indra Bai wife of the applicant committed suicide by hanging in the intervening night of 17-18th August, 2016. It is alleged that the applicant who is the husband was married to the deceased in the year 2007. Thereafter, the applicant for last six months used to torture the deceased and he has brought one lady as his wife, therefore the applicant has abetted the deceased to commit crime. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and on the trivial issue the incident happened and the applicant has not abetted the deceased to commit crime, charge sheet has been filed, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of father Churanlal. Taking into facts and circumstances of the case, charge sheet has been filed and degree of allegations, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
