The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.24/2016 registered in Police Station New Rajendra Nagar, Raipur, District Raipur (C.G.) for offence punishable under sections 420, 34 of Indian Penal Code & 10 of Protection of Investors Interest Act, 2005.

As per the prosecution case, a report was made by Mannulal Dahariya that the applicant alongwith others allured different persons to invest money in B.N. Gold Real Estate and Allied Company Limited and thereafter amount of Rs.6,13,100/- was deposited in various saving account with assurance that it will be returned with high interest, however same has not been done and the company office was closed and the amount was not paid.

Learned counsel for the applicant submits that the applicant was only agent, he has not committed any offence and he has not taken any policy decision on behalf of the company and the applicant himself have invested the amount in the company, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Perused the reply. As per the reply it is not disputed that the applicant was working as an agent. Taking into role attributed to the applicant, charge sheet has been filed and also for the fact that the applicant has not taken any policy decision on behalf of the company, this court is inclined to release the applicant on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
