Nusarat Parveen W/o Shri Riyaj Kuraishi, Aged About-35 years, Both R/o Simaga, Tahsil - Simaga, District - Balodabazar -Bhatapara (CG) ---- Respondents For Petitioner:- Mr.Samir Singh, Advocate For Respondents:- None present though served Hon'ble Shri Justice Sanjay K. Agrawal Order on Board 14/05/2019
1. The Judicial Magistrate First Class, Simga granted interim maintainable of ₹ 1500/- per month to respondent No.1/wife and ₹ 500/- per month to respondent No.2/daughter, which was enhanced by the Additional Sessions Judge, Bhatapara to ₹ 2000/- per month to respondent No.1 and ₹ 10000/- per month to respondent No.2, against which, this CrMP has been filed by the petitioner herein.
2. Learned counsel for the petitioner would submit that interim maintenance granted to the respondents is shockingly high and the revisional Court is absolutely unjustified in enhancing the amount.
3. I have heard learned counsel for the petitioner and considered his
submissions and also went through the records with utmost circumspection.
4. Considering the price index, medical expenses and expenses to be incurred in the education of respondent No.2, total amount awarded to the respondents cannot be said to be shockingly high warranting interference by this Court under Section 482 of the CrPC.
5. Accordingly, the petition being without substance is liable to be and is hereby dismissed.
