The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.125/2011 registered in Police Station Urla District Raipur (CG) for offence punishable under section 34

(2) of Excise Act.

It is a case of bail jump. The applicant was enlarged on bail on 5/07/2011. Thereafter, he attended the court and on 12/05/2015 he remained absent and eventually arrest warrant was issued on 24/09/2016 and he was arrested on 6/11/2016.

Learned counsel for the applicant submits that the applicant is a labour and he was continuously appearing before the court below for four years and he has not jumped the bail and only on one occasion he could not appear, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary and the documents. Taking into fact that applicant was enlarged on bail and he is in jail since 6/11/2016, considering the period of detention, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
