As arguable points have been raised by the counsel for the appellant assailing the order dated 03.10.2016 passed by the JMFC, Bilaspur, in complaint Case No.13856/14 acquitting the respondent from the offence punishable under Section 138 of Negotiable Instruments Act, this court is of the opinion that strong case has been made out for grant of leave to appeal.

Accordingly, CrMP is allowed. Registry is directed to register the case as an Acquittal Appeal.

Acquittal Appeal is also admitted for hearing. Issue notice to the respondent in accordance with rules.
