This is second bail application for grant of bail to the applicant in connection with crime no.216/2016 registered at P.S. Gudhiyari, Distt. Raipur for the offence punishable u/s 34(2) of the C.G. Excise Act. The earlier bail application was dismissed on 26.10.2016.

Learned counsel for the applicant submits that the seizure witnesses have been examined and they have not supported the case of prosecution, therefore, the bail of the applicant may be considered.

Perused the earlier rejection order. The rejection was made on the ground that as many as 24 cases are standing to the credit of the present applicant. Therefore, predominantly the first bail petition was dismissed on the ground of past antecedents.

Taking into consideration of such fact, no change R a o of circumstances have appeared in this case. Therefore, I am not inclined to consider this bail application. Accordingly, it is rejected.
