Heard on I.A. No. 01 of 2019, which is an application for exemption from filing the certified copy of the Order dated 17.07.2019 passed in WPS No. 5231 of 2019.

On due consideration of the application, the same stands allowed.

The present Review Petition has been filed seeking review of the Order dated 17.07.2019 passed in WPS No. 5231 of 2019. 4.

The contention of the petitioner is that, review has been filed on the ground that the order passed in the said Writ Petition is not in respect of the dispute raised in the present petition but inadvertently, it appears that a wrong order has got typed in the said writ petition. 5.

The counsel for the petitioner submits that, the case of the petitioner in fact is one, which has been covered by a decision passed by this Court in the case of Yashwant Kumar Bhardwaj Vs. Municipal Corporation, Durg & Another passed in W.P. No. 3977 of 2003, decided on 03.04.2006.

Given the facts that, the order dated 17.07.2019 does not match the facts of the case of the petitioner. The said impugned order deserves to be reviewed and a fresh order needs to be passed in WPS No. 5231 of 2019.

With the aforesaid reason, the present Review Petition stands allowed. The Writ Petition No. 5231 of 2019 is ordered to be listed for a fresh adjudication on 01st October, 2019.

The Registry is directed to ensure that Writ Petition be listed on the 01st October, 2019 for further hearing. The Review Petition, therefore, stands allowed.
