Heard on the application filed under Section 439 of the Cr.P.C. This is first bail application before this Court by the applicant for regular bail. The applicant has been arrested on 01-09-2017 in connection with Crime No.37/2017 registered at Police Station Chalgali, District BalrampurRamanujganj, C.G. for the offence under Section 420, 467, 468, 471, 477, 34 of the IPC.

It is submitted on behalf of the applicant that the applicant has been falsely implicated in this case. The applicant had been simply a labour in the said scheme of ujsxk@eujsxk. The main accused Alok Gupta has been granted bail by the trial Court itself for the reason that the amount of defalcation has been refunded and deposited by him. No case is made out against the applicant. Hence, it is prayed that the applicant may be granted regular bail. 3.

Learned counsel for the State/non-applicant opposes the application and submission made.

Heard learned counsel for the parties and perused the case diary. 5.

As the case is, one FIR was lodged in Police Station Chalgali, District

-2Balrampur-Ramnujganj that a fake muster roll was prepared to withdraw Rs.1,50,000/- from the State exchequer regarding the labour work in eujsxk, on the basis of this information the case has been registered. 6.

Considered on the submissions made and contents of the case diary. 7.

As the main accused in this case has already been granted bail by the trial Court, hence on the ground of parity this applicant also deserves to be released on bail.

Consequently, the application (MCRC No.7375/2017) filed under Section 439 of the Cr.P.C. by the applicant is hereby allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, for his appearance as and when directed. 9.
