The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.267/2016 registered in Police Station Torwa, Bilaspur Distt. Bilaspur (C.G) for offence punishable under section 392/34 of Indian Penal Code.

As per the prosecution case, on 14/09/2016 a report was made by Manoj Kumar that after completing his duty while he was going back to his home, he was intercepted by the applicant and two others and on the point of knife Rs.1400/- and mobile was looted. 3.
Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, no allegation is attributed to the applicant and no seizure is made from the applicant and only vegetable cutting knife has been recovered which is generally available in house, therefore the applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail. 5.
Perused the statement of Manoj Kumar which shows that the applicant have been identified that he was part of the gang while loot was committed. Taking into such statement, this court is not inclined to release
the applicant on bail.
