This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.

The applicants have been arrested in connection with Crime No.138/2018 registered in Police Station Bodla, District Kabirdham (C.G.) for the offence punishable under Section 34(2) of CG Excise Act. 3.

Argument heard.

Case of the prosecution, in brief is that on 02/08/2018, 135 bulk liters of foreign liquor has been seized from the possession of the applicants and coaccused Suraj Singh. 5.

Counsel for the applicants submits that applicants are falsely implicated in the present case.

Counsel for the State submits that there is no antecedents reported against

the applicants.

Counsel for the applicants further submitted that witness of the memorandum and seizure and I.O. have been examined, thus applicants may be released on bail.

The third bail application of co-accused Suraj have already been dismissed by this Court.

Looking to the facts and circumstance of the case, looking to the huge quantity of seized foreign liquor, looking to the impact of granting bail to the applicants on society, the present bail application is rejected. Sd/- (Sharad Kumar Gupta) Judge Kamde
