Shri Ratan Pusty, Govt. Advocate Hon'ble Shri Justice P. Sam Koshy Order On Board 10.10.2018 The claim of the petitioner is for grant of promotion from the post of Head Constable (MT) to the post of ASI (MT).

The limited grievance which the petitioner has raised is that one Jageshwar Singh, Head Constable (VOL) has been given seniority from the date he was given promotion to the post of Head Constable but in the case of the petitioner, he has not been given seniority from the date he was promoted as Head Constable and as such the position of the petitioner in the gradation list has got lowered.

Perusal of the record shows that the petitioner has not made any sort of representation in this regard to the authorities in the Department and straightway filed the present writ petition.

Given the said fact, let the petitioner file a detailed representation to respondent no.2 within a period of 4 weeks from today. It is directed that the petitioner shall give complete details of his claim and contention substantiated with relevant documents and the respondent no.2 in turn shall decide the representation within a period of 3 months from the date of receipt of the said representation. It is expected that the authority would consider the case objectively keeping in view the parity which the petitioner is intending to draw with the other similarly placed person. 5.
