Sam Koshy Order On Board 10.10.2018 The challenge in the present writ petition is to the action of the respondents where they are initiating steps for relieving the petitioner from Vikaskhand Kartala, District Korba to Vikaskhand, Jaijaipur, District JanjgirChampa. 2.

The petitioner on an earlier instance had filed a writ petition i.e. WPS No. 5774/2017. This Court on 03.11.2017 had disposed of the writ petition directing the respondents to decide the representation and till then the

status quo was ordered to be maintained. Now, almost 11 months have passed, the respondents have not taken any decision on the representation which was made by the petitioner immediately on 08.11.2017 and which is still pending consideration before the authority. On the contrary the respondents are now initiating steps for relieving the petitioner to the transferred place in accordance with the order of transfer dated 14.08.2017. 3.

Given the aforesaid facts and circumstances of the case, particularly taking note of the fact that for almost a period of 11 months the petitioner has been permitted to work at the previous place of posting, the respondents are expected to take a decision on his representation which till date has not been decided.

Accordingly, the writ petition in its present form stands disposed of with a direction to respondent no.1 to take a decision on the representation so made by the petitioner and till the representation is decided finally by the authority concerned, the interim relief earlier granted by this Court on 03.11.2017 in WPS No. 5774 of 2017 shall remain in operation.
