This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.205/2016 registered at Police Station- Nandini, District Durg (C.G.) for the offence punishable under Section 20(B) of NDPS Act. 2.

As per the prosecution case, on a secret information received on 31.07.2016, from the Car bearing No.C.G.04-ZD-2636, total 16 Kg of Cannabis were recovered from the possession of the present applicant, who was one of the inmate of the Car. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated and the seizure of Cannabis was not made in person from the present applicant, therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the seizure. Taking into the quantity of seizure made i.e. 16 Kg of Cannabis from the possession of the present applicant, I am not inclined to release the applicant on bail. 6.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed.
