Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 14/12/2017 Heard.
1. Both the bail applications are heard together and decided by this common order, as they are arising out of same crime number.
2. The applicants have been arrested in connection with Crime No.94 of 2017 registered at Police Station- City Kotwali, District Mungeli (C.G.) for the alleged commission of offence under Section 420, 467, 468, 471 & 120-B of IPC.
3. Case of the prosecution is that one co-accused Punaram impersonated as
-2Ramji and submitted a partition deed before Patwari which led to partition of holding and substitution of name of Ramji with that of Atmaram Sahu. In this manner, a forged rin pustika was prepared and submitted before the Court by Atmaram Sahu who stands as surety for the purpose of grant of bail.
4. At the outset, learned counsel for the applicant-Atmaram Sahu seeks to withdraw the bail application with liberty to revive in case delay in trial.
5. Learned counsel for the applicant Siddhram Sahu would submit that he has been involved on the ground that he was the witness to the partition deed otherwise he is not the person who has submitted the document before the Court.
6. On the other hand, learned State counsel opposes the prayer and submits that the manner in which the forged document was prepared all the accused including the applicant Siddhram Sahu is involved.
7. Considering the submission, nature of allegation against Siddhram Sahu and that the investigation is complete, charge-sheet has been filed and the applicant is in jail since 20.08.2017, the bail application of Siddhram Sahu is allowed.
8. It is directed that the applicant-Siddhram Sahu shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- along with one local surety for the like amount to the satisfaction of the concerned trial Court with following further conditions:
(i) The applicants shall not act in any manner which will be prejudicial to fair and expeditious trial; and (ii) The applicants shall appear before the trial Court on each and every date given to them by the said Court till disposal of the trial. 9.
Accordingly, the application of applicant- Atmaram Sahu is dismissed as withdrawn.
