The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.130/2016 registered in Police Station Lalpur, District Mungeli (CG) for offence punishable under section 20-B of Narcotic Drugs and Psychotropic Substance Act. 2.

As per the prosecution case, on 28/07/2016 the applicant and other co-accused were travelling in a motorcycle from their possession total 8.500 grams of cannabis were recovered and from the applicant 4 kg of cannabis were recovered.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, no seizure was made in person from the applicant, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary. Considering the seizure memo prima facie it appears from the applicant 4 kg of cannabis were recovered. Therefore, taking into quantity of cannabis so seized, this court is not inclined to

release the applicant on bail.
