The grievance of the petitioners is that they were originally working
against the District level posts. However, subsequently, the respondents have called upon the petitioners and posted them at directorate whereupon the petitioners were working for quite sometime. The petitioners have also moved applications for absorption.

Contention of the counsel for the petitioners is that the Department has already absorbed many of the persons but for some reasons the case of the petitioners has not been finalized and their case is pending consideration before the authorities. He further submits that meanwhile, the respondents have now issued an advertisement and there is all likelihood that the posts against which the petitioners are working would be filled up by the regular employees and in the course, the petitioners would lose their seniority at the District Level and also would not get the benefit at the directorate.

Given the limited grievance which the petitioners have raised, let the respondent no.2 take a decision on the pending representation of the petitioners at the earliest preferably before the recruitment process is completed against the advertisement which has already been published. Let the petitioners make available the order passed by this Court to the respondent no.2 along with any other representation if they intend to file at the earliest.
