1. By the impugned order, the plaintiff's suit has been restored to its original file for hearing and disposal by the trial Court.
2. Learned counsel for the petitioner would submit that the impugned order is unsustainable and bad in law.
3. After hearing learned counsel for the petitioner at length, I am of the considered view that the trial Court is absolutely justified in restoring the suit finding sufficient cause for non-appearance when the case was called out for hearing. I do not find merit in this writ petition.
4. Accordingly, the writ petition deserves to be and is hereby dismissed. No cost(s).
