Learned counsel for the applicant seeks permission of this Court to withdraw the instant bail application filed under Section 439 of Cr.P.C. with liberty to repeat the same after filing of the chargesheet. It is ordered as prayed for.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed as withdrawn with aforesaid liberty.

However, it is made clear that after filing of the charge-sheet, the case will be decided on merits.
