At the outset, learned counsel for the applicant prays that he be permitted to withdraw the instant MCRC(A) with liberty to file appropriate bail application before the concerned criminal court under Section 437 Cr.P.C. He prays that if possible, the application may be disposed of same day.

As prayed, the instant MCRCA is disposed of without any appreciation on its merits. The applicant may file application under Section 437 Cr.P.C. before the concerned court and the court below is directed to dispose of the same in accordance with
procedural and other laws as expeditiously as possible and if possible, same day.
