This is second bail application under Section 439 of Cr.P.C. The earlier bail application was dismissed as withdrawn on 20/09/2016 vide M.Cr.C. No. 5588/2016 with liberty to repeat the same after examination of the prosecutrix. Learned counsel for the applicant submits that prosecutrix has not been examined till date and seeks permission of the court to withdraw this second bail application.

Perused the earlier order dated 20/09/2016 wherein liberty was given to the applicant to repeat the bail after examination of the prosecutrix.

Accordingly, the second bail application is dismissed as withdrawn. However, liberty shall be available to the applicant to repeat the bail application after examination of the prosecutrix.
