1. The present application u/s 438 of the Cr.P.C. for grant of anticipatory bail has been filed by the Applicant apprehending his arrest in connection with Crime No. 41/2012 registered at Police Station Civil Line, Raipur whereby he has been charged for the offence punishable under Sections 420, 409 R/w 34 Indian Penal Code and Sections 3, 4, 5 and 6 of the Prize Chits and Money Circulation Schemes Banning Act, 1978.

2. After some arguments, learned Counsel for the Applicant prays for withdrawal of the present Application with a liberty that he may be permitted to move regular bail application before the concerned Court who in turn may be directed to consider the Application on the same day.

3. The said prayer is accepted.

4. Accordingly, the present Application stands dismissed as withdrawn. However, it is made clear that in the event, if the Applicant surrenders before the concerned Court and moves an application for regular bail, the same, if possible, may be considered on the same day.
