This is the second bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.240/2016 registered at Police Station- Civil Lines, District Bilaspur (C.G.) for the offence punishable under Section 420/34 of Indian Penal Code & Section 138 of the Negotiable Instrument Act. 2.

The first bail application was dismissed as withdrawn on 08.11.2016 in MCRC No.6677 of 2016 with liberty to repeat the same after examination of the victim/complainant. 3.

On being enquired, it is submitted by the learned counsel for the applicant that the victim/complainant has not been examined till date. Taking into such fact, I do not find any change of circumstances to reconsider the instant second bail application. 4.

Accordingly, the second bail application is dismissed at the admission stage itself.
