Hon'ble Shri Justice Narendra Kumar Vyas Order On Board 19.08.2021

1. The petitioner has filed present CRMP under Section 482 of the Criminal Procedure Code, 1973 challenging the order passed by the Revisional Court by which the revision has been dismissed by the learned 3rd Additional Sessions Judge, Bilaspur on 07.10.2017 affirming the order dated 14.05.2015 by which the charges under Sections 420, 466, 471 has been registered against the petitioner.

2. Learned counsel for the petitioner would submit that in pursuance of FIR being Crime No.31/2015 the criminal case has been registered before the learned Judicial Magistrate First Class on 25.03.2015 and since then trial is pending. The trial is pending since last 5 years therefore, as per the directions issued by the High Court that the cases which are pending for more than 5 years should be disposed of on priority basis. The trial Court may also be directed to expedite the trial.

3. In view of the directions issued by the High Court, it is directed that the learned Judicial Magistrate First Class should complete the trial within a period of one year from the date of production of the copy of the order.

4. Learned trial Court will also see that the unnecessary adjournment sought by the prosecution or by the accused shall not be considered unless unavoidable circumstance is made out, no adjournment to either party should be allowed.
