The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.199/2016 registered in Police Station Tamnar, District-Raigarh (C.G.) for offence punishable under section 457/380 read with section 34 of IPC.

As per the prosecution case, on 20/09/2016 a complaint was made by Pokhraj Kumar Singh that theft of photo printer and camera has taken place in his shop and subsequently the applicant was arrested in another crime and from his possession the articles were seized on his memorandum.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, the applicant was arrested in another crime and alleged memorandum was obtained, on the basis of recovery made applicant has been implicated, charge sheet has been filed, no further investigation would be necessary, therefore the applicant may be enlarged on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Considering the facts and circumstances of the case, degree of allegation, charge sheet has been filed and applicant is in jail since 21/09/2016, this court is inclined to release the applicant on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
