Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 11/10/2018 (1) By the impugned order dated 24.08.2018, plaintiff's opportunity to lead evidence has been closed finding no merit, against which, instant writ petition has been filed questioning the same.

(2) I have heard learned counsel appearing for the petitioner and perused the order impugned with utmost circumspection.

(3) Taking into consideration the fact that earlier adjournments were granted on showing sufficient reason. In the interest of justice, the plaintiff is granted one more opportunity to

lead evidence on 15.10.2018 i.e. the next date fixed by the trial Court for recording the evidence of the parties. Accordingly, it is directed that the plaintiff will keep his witnesses namely Gajendra Singh, Prem Singh Chandel and Samer Vikrant Singh present before the trial Court on 15.10.2018 and they will be examined and cross-examined subject to payment of cost of Rs. 2,000/- payable to the District Legal Aid Authority, Durg. However, the plaintiff will file his affidavit under Order 18 Rule 4 of the Code of Civil Procedure on or before 15th October, 2018. No further adjournment would be granted for that purpose. (4) With the aforesaid observation, the writ petition stands disposed of. Certified copy, today.
