The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.324/2016 registered in Police Station Koni, District Bilaspur (C.G.) for offence punishable under sections 457, 380 of Indian Penal Code.

As per the prosecution case, a report was made by Abdul Junaid on 17/11/2016 that the applicant alongwith other co-accused entered into the petrol pump and amount of Rs.2,47,225/- was stolen which was turned with connivance of one Ram Khilavan who was working in petrol pump. Thereafter, entire amount was recovered from the applicant and other co-accused and amount of Rs.25,000/- was recovered from the applicant.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, only seizure of amount has been made, charge sheet has been filed, no further investigation would be necessary, therefore the applicant may be enlarged on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Considering the facts and circumstances of the case, charge sheet has been filed, no further investigation would be necessary, this court is inclined to release the applicant on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
