1. Mr. Vivek Mishra, learned counsel for applicant submits that there is inordinate delay in concluding the trial. He submits that prosecutrix has been examined on 24.10.2019 before the trial Court, but even after lapse of two years, trial could not be concluded, hence, applicant may be released on bail.
2. Mr. Raghvendra Verma, learned State counsel submits that applicant has not placed any material on record to show that there is delay in conclusion of trial on account of any fault of prosecution. He further referred to paragraph 2 of statement of prosecutrix recorded before the trial Court and would submit that even otherwise prosecutrix has levelled serious allegation against applicant of establishing physical relationship with minor girl, hence, applicant is not entitled for grant of bail.
3. At this stage, learned counsel for applicant would submit, that he may be permitted to withdraw this bail application, however, he further submits that looking to the pendency of case for about two years, a direction be issued to trial Court to conclude the trial at the earliest.
