1. Heard on application (I.A. No.1) for condonation of delay in filing the restoration application and also prayer for restoration of appeal.

2. Taking into consideration the submission of learned counsel for the applicant and cause shown in the application, we are inclined to condone the delay. Accordingly, I.A. No.1 is allowed.

3. The non appearance of the counsel has been accounted for in the application which we accept. Accordingly, the order of dismissal for want of prosecution is recalled and the FAM No. 122 of 2019 is restored to its original number, subject to deposit of Rs. 1,000/- in the High Court Legal Aid Committee.

4. Accordingly, the MCC is allowed.
