Learned counsel for the applicant seeks permission of this Court to withdraw the instant bail application filed under Section 439 of Cr.P.C. with liberty to file afresh after examination of the seizure witnesses.

It is ordered as prayed for.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed as withdrawn with aforesaid liberty. However, it is made clear that the same will be decided on merits.
