Challenge in the present writ petition is to the order dated 23.8.2019 (Annexure P-1) whereby the petitioner has been transferred from Depot Magarlod, North Singpur, Forest Division, Dhamtari to Gariyaband Forest Division, District Gariyaband.

Contention of the counsel for the petitioner is that the petitioner is more than 61 years of age and has got only 9 months service left for his superannuation.

Considering the fact that the petitioner has got only 9 months service left for his superannuation, the impugned order of transfer at this juncture does not prima facie seems to be proper, legal and justified, particularly taking into consideration the transfer policy of the State Government itself. 4.

Given the said fact, let the petitioner within 10 days from today make a suitable representation to the respondents which in turn shall be considered and decided by the respondents as expeditiously as possible, preferably within a period of 45 days from the date of receipt of representation. 5.

Till the representation is decided, the effect and operation of the impugned order of transfer (Annexure P-1) shall remain stayed so far as the petitioner is concerned.
