Hon'ble Shri Justice Parth Prateem Sahu Order on Board 09/12/2021 Heard.

1. Learned counsel for applicant submits that due to inadvertent mistake this bail application under Section 439 of Cr.P.C is filed challenging the impugned order. As per provisions of Section 14(A) of Scheduled Cast/Scheduled Tribes (Prevention of Atrocities) Act, 1989, appeal would lie against the impugned order. Hence, he may be permitted to withdraw this bail application with liberty to file appeal under Section 14(A) of the Act of 1989. He also prays that Registry may be directed to return back copies of Annexures A/1 to A/4.

2. In view of above, bail application is dismissed as withdrawn with liberty as prayed for.

3. Registry is directed to return back certified copies and original photographs of Annexures (A/1 to A/4) after retaining photocopies of the same.
