1. The challenge in the present writ petition is to the order Annexure P/1 dated 13.09.2019, whereby the petitioner has been transferred from the post of Chief Executive Officer, Janpad Panchayat Farsabahar, District Jashpur to the office of the Assistant Commissioner, Tribal Development, Raigarh.
2. The main ground of challenge in the present writ petition is that the order of transfer has been made during the ban period. According to the petitioner the ban period was till 23.08.2019, but the impugned order of transfer in the present case has now been passed on 13.09.2019 i.e. during the ban period.
3. Given the said facts, let the petitioner make a detailed representation to the respondents within a period of 10 days from the date of receipt of the copy of this order and the respondents in turn shall decide the same within a further period of 45 days from the date of receipt of the representation.
-24. Meanwhile, the effect and operation of the impugned order shall remain stayed so far as the petitioner is concerned.
