1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 281/2016 registered at Police Station Mahasamund, Distt. Mahasamund (C.G) for the offence punishable under Section 489-B and 489 of IPC.
2. As per the prosecution case, on getting information by the police that the applicant is in possession of the counterfeit notes a raid was conducted and from the possession of the applicant, 170 counterfeit notes of Rs.1000/- denomination amounting to Rs.1,70,000/- and 16 notes of Rs.500/- denomination amounting to Rs.8000/- were seized from the present applicant. It is alleged that the applicant and other accused have purchased currency notes amounting to Rs.8,00,000/- for Rs.50,000/- from one Shabas Khan.
3. Learned counsel for the applicant would submit that the
main allegations have been attributed to Shabhas Khan who gave such currency notes to the present applicant, therefore, the applicant has not committed any offence.
4. Per contra, learned State Counsel opposes the bail.
5. Perused the case diary and documents.
6. Considering the nature of crime which was committed wherein the fake currency notes amounting to Rs.1,78,000/- were recovered from the applicant and circulation of such counterfeit notes causes serious dent to the economy of the country, I am not inclined to allow this bail application. Accordingly, it is rejected.
