The applicant has filed this application under Section 439 of the Code of Criminal Procedure for grant of regular bail in connection with Crime No. 180/2019 registered at Police Station : Sirgitti District Bilaspur (C.G.) for the offence punishable under Section 302/34 of IPC.

As per the prosecution case, the allegation against present applicant is that, on some dispute, the present applicant along with co-accused, committed murder to deceased, Dinesh Garhewal with the help of brick and stone. Based on this, offence has been registered against the applicant and he has been arrested.

Learned counsel for the applicant submits that the applicant

has been falsely implicated in the crime in question. He further submits that the applicant is in jail since 04.06.2019, and he is ready to furnish adequate surety and shall abide by all the directions and conditions which may be imposed by the Court, therefore, he may be released on bail. 4.

On the other hand, State counsel opposes the bail application.

I have heard learned counsel for the parties and perused the record.

Considering the totality of the facts and circumstances of the case and further considering the nature and gravity of the crime, at this stage, I am not inclined to release him on bail. 7.

Accordingly, his application filed under Section 439 of the Code of Criminal Procedure is rejected.
