1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 198 of 2016 registered at Police Station Kondagaon, Distt. Kondagaon (C.G) for the offence punishable under Section 294, 323, 506, 326 of IPC.

2. As per the prosecution case, a report was made by Anant Ram Korram against the present applicant that an altercation took place between the applicant and victim Kartik Ram due to over flow of water to the field of applicant through the field of victim whereby the applicant has picked a quarrel and assaulted the victim by way of Axe as a result of which he sustained 3 injuries and because of such injury, the victim has lost vision in one of the eyes.

3. Learned counsel for the applicant would submit that on a trivial dispute the incident happened and there is no intention to cause him such injury. He further submits that

the charge sheet has been filed and the applicant is in jail since 10.11.2016, therefore, he may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail.

5. Perused the case diary documents.

6. Considering the nature of injury which was caused due to which the the victim has lost vision in one of the eyes, I am not inclined to allow this bail application. Accordingly, it is rejected.
